The session to annul the DNU allowing bitcoin contracts in Argentina failed
- Opposition blocs gathered 121 of the 129 deputies needed to open the chamber.
- The Civil Code maintains the requirement to fulfill debts in the agreed currency.
The attempt by the political opposition to annul Decree of Necessity and Urgency (DNU) 70/23 failed on October 15, 2026, in the Chamber of Deputies of Argentina.
The critical blocs barely managed to gather 121 legislators in the chamber, falling eight votes short of the quorum of 129 necessary to start the session.
Thus, the economic deregulation promoted by the Executive Power remains active and, with it, the legal viability of signing commercial, real estate, and financial contracts using bitcoin (BTC) and cryptocurrencies.
The blockage of the legislative debate was made possible thanks to the support of provincial governors from the north and center of the country, who directly influenced the decisions of their benches.
The absences of key deputies from Tucumán, Santa Fe, and Jujuy were decisive for the ruling party to thwart the opposition's advance, while other provincial sectors participated amid parallel discussions on national infrastructure investments.
Consequently, the legal framework for agreements between private parties continues to be governed by the modifications that the decree introduced in the Civil and Commercial Code of the Nation.
In practice, the continuity of DNU 70/23 implies that any person or company can agree on the payment of rent, the sale of real estate, or the settlement of a loan directly in bitcoin or cryptocurrencies.
In the area of leases, following the repeal of the previous rental regulations, payments can be set in any form at the free discretion of the parties involved, and the tenant cannot demand payment in a currency different from that specified in the document. Furthermore, it can be freely stipulated in which asset the guarantees and security deposits are delivered.
Article 765 of the modified regulation establishes that the obligation is to pay money if the debtor owes a certain amount of currency, <
In addition, Article 766 requires the debtor to deliver the corresponding amount of the designated form at the time of signing. This flexibility, which former chancellor Diana Mondino confirmed in December 2023 by stating that agreements can be made in bitcoin or cryptocurrencies, rests on the principle of the parties' will.
The failure of the opposition session ensures certainty in the short and medium term for users of digital assets in Argentine territory. With an upcoming legislative call officially scheduled for October 21 focused on a different agenda, the market retains a valid regulatory backing that shields the use of bitcoin as a legally binding means of exchange, protecting voluntary agreements from potential judicial interventions that seek to alter the original payment conditions.
It is worth clarifying that the annulment attempt and the negotiations that shielded the decree did not primarily respond to a discussion around cryptocurrencies. Instead, they were motivated by central issues of the DNU such as the deregulation of regional economies, labor policy, and the sale of rural lands.
Thus, the use of bitcoin and cryptocurrencies in real estate and commercial contracts survives as a rebound effect of a broad structural reform whose political debate center traversed completely foreign paths to the ecosystem created by Satoshi Nakamoto.
